Information on the terms and conditions of purchase using the inspiratio.ro website

1. Identity of the trader

The products in the shop on the inspiratio.ro website are sold by SK-HG Dienste S.R.L. with registered office in Brașov, Curtea Johannes Honterus, nr. 9, jud.Brașov, J8/1979/29.08.2018, Unique European Identifier ROONRC.J8/1979/2018, C.U.I. 39808380, telephone 771512986, e-mail giftstudio@inspiratio.ro.
For goods sold on consignment we indicate the manufacturer/importer on the respective product webpage.

2. Conditions under which orders may be placed

Orders may be placed by persons who have reached the age of 18.
By placing an order on the inspiratio.ro website you confirm that you are over 18 years of age and have the legal capacity to enter into contracts.

To place an order it is necessary to provide the following information: your name and surname, delivery address, e-mail address and/or telephone number where you can be contacted for order confirmation and delivery of products, method of payment. In case of incomplete/erroneous data you will be contacted by the inspiratio.ro team. The lack of this information or some of them as well as the indication of erroneous data may lead to the impossibility of placing/processing the order or its cancellation.

Also, in order to place a valid order, you must confirm that you have read and accepted the terms and conditions of purchase in this document by ticking the two boxes entitled: “I have read and accepted the terms and conditions of purchase”, “I accept the terms and conditions of purchase”. Failure to confirm your acknowledgement and acceptance of the terms and conditions of purchase will make it impossible to place your order.

Orders may be placed by buyers from within Romania. We do not currently sell or ship products outside the country.

3. Processing of personal data

Your personal data are processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as GDPR) and in accordance with national data protection and security legislation in force.

4. Conclusion of the contract

The posting of products in the shop on our website is not an offer to sell, but a request for an offer on your part. The posting of products in the shop on our website does not constitute a guarantee of the availability of those products.

Placing an order via the shop on our website does not constitute the conclusion of a contract for the sale of the products. The contract of sale shall only be deemed to have been concluded once the order has been confirmed by sending a message to the e-mail address or telephone number provided. If you have placed an order and paid the price of the products but we have not confirmed the order within 3 working days, we will refund the price within 2 working days from the date on which we have informed you of the updated status of the order.

If you have placed an order for more than one product, it is possible that only some of them will be confirmed.

5. Availability of products

We accept orders only while stocks last. If you have ordered more than one copy of a product and it is not available in the quantity specified in your order, we will contact you to confirm that we will keep your order for the quantity available or cancel it.

6. Delivery of orders

Placed and conformed orders will be delivered by Fan Curier courier service to the address indicated by you.
The cost of delivery is borne by the buyer separately from the price of the products ordered.
Delivery is free of charge if you choose to pick up the ordered products from our physical store in Curtea Johannes Honterus nr. 8, 500025 Brasov, Romania.
For orders over 200 lei, delivery is free anywhere in Romania.
The order placed must contain a valid phone number and full address in order to be processed. In case of invalid data you will be contacted by e-mail/telephone by the INSPIRATIO Team.
We reserve the right to cancel an order if these details are not corrected within 2 working days or if we are unable to contact you.
Delivery will be made within 1-3 working days of placing the order.
No deliveries are made on Saturdays and Sundays.
In certain situations, especially during holidays or Black Friday, the delivery time may be extended beyond our control.

7. Price and payment

The prices of the products are those mentioned in the shop on our website and apply exclusively to products sold through it. Prices include value added tax (VAT) and exclude delivery costs.
The price of products in our physical shop may differ from the price of products posted on the website.
Prices may be changed unilaterally by us without prior notice.
The prices of products that are the subject of confirmed orders cannot be changed.
Prices of products mentioned on our website that are incorrect do not give rise to our obligation to sell the product at the incorrect price posted. We will inform you as soon as possible in such a case, and you will then have to confirm whether you wish to maintain or cancel the order, taking into account the actual price of the product. We assure you that we make every effort to avoid such situations.
Payment can be made by cash on delivery, online by bank card or by money order. When placing an order you must choose one of these payment methods.
Bank card payments are made via the MobilPay Netopia application.
By using the MobilPay Netopia payment application, you confirm that you are the holder of the bank card and that you are authorised to use it for payment.

If you pay by money order, your order will be dispatched after confirmation that our bank account has been credited with the amount paid.
After each payment we will confirm receipt of the price of the products ordered.

8. Ownership and risk transfer

Title to the products ordered and the risks shall pass to you upon delivery, provided that the price and delivery costs have been paid in full.
In the case of the return of products, the transfer of risk shall take place on the date of delivery of the products to the return address and the transfer of ownership shall take place on the date of the refund of the price to your account.

9. Returning products

The buyer has the right to return the products purchased from the shop on the inspiratio.ro website, without penalty and without giving a reason, within 14 calendar days of receipt of the products, in accordance with the provisions of GEO 34/2014 on consumer protection in the conclusion and performance of distance contracts.
The transport costs for the return of the products will be fully borne by the customer and the return will be made within 14 calendar days.

The products will be returned to SK-HG Dienste S.R.L. within 14 days from the date of communication of withdrawal from the contract. The return should be made to the address: Brașov, Curtea Johannes Honterus, nr. 9, jud.Brașov.
The refund of the price of the products and the original delivery cost will be made within 2 working days of receipt of the returned products. The refund will be made by the same method of payment.
Not accepted for return:
– personalized products;
– sealed products which cannot be returned for health protection or hygiene reasons and which have been unsealed by the buyer;
– sealed audio or video recordings or sealed software that have been unsealed after delivery;
– products damaged after delivery to the purchaser through the fault of the latter; the product shall be considered damaged through the fault of the purchaser if the damage was not reported on the day of delivery.

10. Guarantees

SK – HG DIENSTE S.R.L, owner of the INSPIRATIO.RO website, guarantees the conformity of the products sold and undertakes to deliver to you products: which correspond to the characteristics set out in the sale-purchase contract (description, type, quantity, quality, functionality), are accompanied by the accessories and instructions set out in the contract, correspond to the purposes for which goods of the same type would normally be used, have the characteristics normal for goods of the same type in terms of durability, functionality and safety.
The goods sold shall be accompanied on delivery by the guarantee certificates issued by the manufacturers.

However, for certain categories of products, in particular those produced by hand and/or using natural materials (leather, stone, wood, fabrics dyed with natural pigments, etc.), durability and certain characteristics may be affected by the methods and materials used in production, which is indicated in the product description. For these product categories, the guarantee is offered within the limits and under the conditions indicated on the product description page.

SK – HG DIENSTE S.R.L. is liable for any lack of conformity which exists at the time of delivery and which is established during a period of 2 years from the date of delivery. Non-conformities detected during a period of 1 year from the date of delivery are presumed to have existed at the time of delivery, unless the contrary is proved or unless this presumption is incompatible with the nature of the products or the nature of the non-conformity.

The non-conformity of a product must be reported to SK – HG DIENSTE S.R.L. within 48 hours of its discovery by sending an e-mail to giftstudio@inspiratio.ro. The message complaining of the non-conformity must describe the non-conformity. It is also advisable to include photographs of the non-conformity.

Our team responds to messages of non-compliance within 2 working days. Depending on the specific situation we may ask you to return the product for analysis of the non-conformity. Returns can be made by courier/mail or directly to our physical store in Brasov, Curtea Johannes Honterus nr. 8, 500025 Brasov, Romania.

Complaints will be resolved within 2 working days of receipt or return of the product (if we have requested this for non-conformity analysis).

In the event of non-compliance, depending on your choice, we will engage:

  • To repair the non-conforming product at our sole expense; however, if repair is not possible or involves disproportionate costs in relation to the value of the product, we shall be entitled to decide to terminate the contract and refund the price;
  • To replace the non-conforming product at our expense; the replacement period is 15 days from the date of receipt of the complaint; as some products are unique and/or require a longer production time, we will inform you about the duration of the replacement procedure and if it exceeds the 15-day period, you have the right to request the termination of the contract and the refund of the price of the product in question; if the replacement of the product involves disproportionate costs in relation to the value of the product, we have the right to decide to terminate the contract and refund the price;
  • Reduce the price if the non-conformity is serious enough to warrant a reduction and repair is not possible or does not eliminate the non-conformity;
  • In the event of a serious non-conformity, terminate the contract and refund the price and delivery costs; the refund shall be made within 2 working days of the return of the non-conforming products, using the same method of payment used by the purchaser to pay the price; if several products have been purchased, only some of which are non-conforming, and those not affected by the non-conformity can reasonably be retained, the contract shall be partially terminated only in respect of the non-conforming products.

In case of non-conformity of the products, all costs of exchange/delivery/return will be borne by SK – HG DIENSTE S.R.L.

Products damaged through the fault of the buyer, including through failure to comply with the instructions for use or assembly, shall not be considered non-conforming.

Visible non-conformities at the time of delivery (scratches, chips, cracks, splits, discolourations, tears, etc.) must be reported within 48 hours of delivery, after which time they will not be taken into account.

SK – HG DIENSTE S.R.L. accepts no liability for any damage caused by defective products, as the manufacturers are responsible for such damage.

11. Force majeure and fortuitous event

SK – HG DIENSTE S.R.L. is not liable in the event that the non-fulfilment of obligations is caused by force majeure or fortuitous events. The definitions of force majeure and fortuitous event are those laid down in Article 1351 of the Civil Code.

If the case of force majeure or fortuitous event takes effect for more than 3 months, the contract is terminated and the sums received are returned to you.

12. Communications

Communications related to the execution or termination of the contract will be made using the e-mail addresses indicated on our website or provided by you. To the extent that communications cannot be made using electronic mail, communications will be sent by post/mail.

13. Interpretation of conditions

By accepting these terms and conditions you agree that they shall become part of the contract of sale and shall apply in full to our relationship. Partial acceptance of the conditions is not possible.

14. Review of Terms and Conditions

We reserve the right to unilaterally revise/amend these terms and conditions at any time without prior notice. In the case of contracts already concluded, revisions/amendments shall have no effect and the version in force at the time of conclusion of the contract shall apply.

15. Applicable legislation

Romanian law is applicable to the Contract. Disputes are subject to the jurisdiction of the Romanian courts.
